heres what happened:
This phone was shipped out on 2/16. It was packed with the phone intact and all accessories. I have the receipt to prove it. When this person bought this phone after the transaction I emailed him letting him know i was shipping out the phone. He responded with this:Thank you so much for your reply, my only concern is getting it here within 1 week, only because i'm planning to give it to my wife in monterey Ca. on our anniversary Feb 23, 2009 If that can't be done i understand, but please allow me to be reibersed and buy else-where. thank you again! Bill wickAfter realizing his situation I assured him he would initially get it by the end of that week, however since I live in Florida, and he is in California, it was not possible, but I assured him again it would be there by 2/23. There seemed to be some sort of problem with UPS, because I checked the tracking number on that day and it said the package was mis sorted, and would be redelivered on 2/24This is what I wrote him: Bill, I was watching this package all day, and then I saw that they mis sorted the package, and that it will be delivered tomorrow. I really feel horrible about the way this concluded, my intention was to get it to you by today, UPS screwed up, unfortunately there is nothing I can do. All I can say is, I understand your situation, and sympathize with your situation. Sincerely JeffHe never responded to me after that until he got the phone which was yesterday. This is what he wrote when he received the phone:We recieved the package today, Is this some kindof sorry joke? I get a box with NO PHONE IN IT!!!all that was in the box was the instruction bookletsbelt case headphones & soft case but NO PHONE!I want to know what your going to do about this. This whole experience with you has been onea huge disappointment! Let me be clear here, the phone was in the box, with everything that i said was going to be in there. What I feel is, he has the phone, and is upset he did not receive it on the 23rd, or UPS stole it. I did file a damage claim with UPS, T-mobile also confirmed the phone was being used, but could not reveal to me who and where. Paypal is reviewing the case now, and personally I think they are horrible, anyone experience anything like this?

I'd suggest to call police
it's stealing after all

I did, they said it was a civil matter, and to take it to small claims court, if only there were a way I can figure out and prove he has the phone

I gave up on ebay after losing so many auctions to scams. I sold my G1 on amazon, not had one single problem from them. How much did you insure it for? Keep trying t-mobile, try and get a friendly rep on the line and just ask if it's being used in that state or not. When I worked at t-mobile I could track phones (tool was removed from reps) and a few times the people claiming to not have the phone actually had it on one of their other lines! Go after UPS and make sure the person claiming empty box isn't trying to pull a fast one too. Good luck.

I have called t-mobile several times and they told me it is against FCC regulations to give out that info, and that the secret service would be there in a heartbeat. I just wish they can track it, I mean I know for the fact the phone was being used cuz when I called tmobile initially, I had the serial number on my old G1, gave it to the guy and he told me it was being used. I am just hoping Paypal sides with me.

I won the dispute, and they released the $388. They said the box was lost or damaged, and the fact I had the tracking number and receipt, so I guess The seller can win with paypal.
