An Illinois judge has ruled that Sprint Nextel cannot provide mobile coverage in iPCS territory, although it is not clear if that ruling will affect Sprint's partner, Clearwire. Sprint completed its acquisition of Clearwire, in interest of each company's WiMAX offering, last month.
In November, the court decided that iPCS could not restrain a merger between Sprint and Clearwire. This decision affirms that Sprint is illegally selling service in iPCS coverage area, which includes Illinois, Indiana, Iowa, Michigan, Ohio, Pennsylvania, and Tennessee. Debate over whether the ruling applies to Clearwire will begin March 30.
