A lawsuit alleging that AT&T Inc.'s (T) cell phone customers received inferior service after the company's wireless division was sold to Cingular Wireless can proceed as a class action, a federal appeals court ruled Friday.
Not a great day for ATT now is it? :naughty:

Is this based on discontinuation of TDMA or on some other unknown factor? Why specifically did their service deteriorate?

At issue was a clause in old Cingular contracts that forced customers to litigate their grievances independently, instead of grouping together for a class action lawsuit.
Shroyer claimed Cingular let AT&T's service deteriorate in a scheme to force AT&T customers to switch to Cingular under less favorable contract terms.
I guess that's pretty much the gist of it. Looks like they let their service be bad to "force" migrations over to Cingular when they bought ATT. (Blue to Orange). The NEW ATT is trying to say that its old contracts, but obviously they're trying to settle this out of court.
Another thing is the fact that Cingular (although this is true with all carriers) force customers to sign a Waiver of their Right to Class Action Lawsuits, which some courts have ruled is an illegal shield for companies who are engaged in potentially harmful conduct

I've heard Cingular/At&t customers complaining about this from the beginning...I'm glad it finally went through. Good find....We're :eyebrow: you At&t

What about old CINGULAR customers who received inferior service BEFORE the company bought AT&T's wireless division? Don't forget us too!!! :confused::(:p

True, CingulATT is all a mess. First their branding strategies are the dumbest thing i've ever heard of, their claims of "Fewest Dropped Calls" is a lie to the consumers face, and their customer service isn't all great and dandy either. I can't believe i used to sell them during the time that Cingular took ATT over, i'm glad i didn't have to deal with it for long. There was a huge migration fee issue that got taken to court because Cingular was charging ATT customers $18 to move over to Cingular. WTF?!?!
